Please read these Terms and Conditions carefully before using the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

That the professional's license, if applicable, is valid within the state in which he or she practices

You are not allowed to use our services, if you are feeling suicidal or are in immediate crisis.

If your subscription includes private therapy, it means your support package will be included in your private proposal. You first need to apply for a custom proposal package to suit your needs. Please notice that even though our therapists do their best of replying within 24 hours, there are no guarantees. If you experience any delays, please contact us. If you are in immediate crisis - don't use this site. These resources can provide you with immediate help worldwide.
If your subscription includes the community forum, it will be monitored by an administrator. The administrator will respond to any questions within 48 hours excluding weekends and public holidays.
Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a weekly, monthly, bi-monthly, quarterly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it or Alive Wellness cancels it. You may cancel your Subscription renewal either through your online subscription page or by contacting Alive Wellness customer support team: www.aliveprocess.com (click the help icon).
A valid credit card, is required to process the payment for your Subscription. You shall provide Alive Wellness with accurate and complete billing information including full name, address, state, zip or postal code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Heidi Shannon to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Heidi Shannon will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Statement descriptor on your card statement when paying using PayPal is PAYPAL, PAYPAL INTERNET or similar to that. Statement descriptor when paying using credit/debit card is www.aliveprocess.com or Alive Wellness or similar to that.
Our services are subscription based or one off free. This means that you will be charged a one off fee or weekly, monthly or bi-monthly (depending on the selected subscription plan), until you have canceled your subscription. You may cancel your subscription at any time and you will not be charged again. To cancel or to make changes to your subscription, contact us hello@aliveprocess.com
You may pay using any major credit/debit card or PayPal. All payments are made using SSL encrypted connections (https) for maximum security. Our payment service providers will never share your credit/debit card details with us or any other third party.
You can cancel your subscription at anytime and once cancelled your access to the program is immediately revoked.
Refund Policy
We have a 30 or 60-day money-back guarantee from the date of your first subscription payment. However, you are only entitled to a partial refund during the 30 or 60-day money-back guarantee if:
You have completed the modules and the worksheets
You have attended the weekly live calls
You have posted your concern in the community forum

Please note that when you send payments directly to an external therapist (as opposed to our standard checkout routine), other refund policies may apply.
Alive Wellness may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").
You may be required to enter your billing information in order to sign up for the Free Trial.
If you do enter your billing information when signing up for the Free Trial, you will not be charged by Alive Wellness until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, Alive Wellness reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
Alive Wellness, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle for new users however previous users will have no change to the fee they agreed to pay on sign up.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene.
As therapists, coaches and wellness professionals (known for the purposes of this agreement as ‘therapists’) you are not Alive Wellness' employees nor agents nor representatives, but an independent provider.
Alive Wellness' role is limited to enabling the services of the therapist while the therapist’s services themselves are the responsibility of the therapist who provides them.
It is your sole responsibility as a therapist to ensure that you only give your services to people you are allowed to give your services to, depending on local, state or national restrictions.
As a therapist, you could be a Covered Entity for purposes of compliance with the Health Insurance Portability and Accountability Act of 1996, Public Law 104191 ("HIPAA"), and you may also be subject to similar state laws. Aliveprocess.com is a technology provider, not a Covered Entity. While use of our technology is designed to provide security of information as we make no warranty or representation that compliance with this Agreement or use of its products or services will be adequate or satisfactory to fully comply with HIPAA or state privacy laws.
It is your sole responsibility as a therapist to ensure that the contact and licensure information in your user profile is current and accurate. This contact information includes, but is not limited to, name, address, phone numbers, email addresses, states and types of licensure. Changes to your contact information can be made in the personnel section of our website.
It is your sole responsibility as a therapist to ensure that you have legal coverage in case there is litigation etc.

Being a therapist, our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Alive Wellness. All abuse will be reported.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
You agree to indemnify, defend and hold harmless Alive Wellness, and its officers, directors, owners, employees, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of (a) any User Contributions, or (b) breach by you or any user of your account of these Terms of Use or any representations, warranties and covenants contained in these Terms of Use. You shall cooperate fully and reasonably in the defense of any such claim. Alive Wellness reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
No waiver by Alive Wellness of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Alive Wellness to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
The Terms of Use constitute the sole and entire agreement between you and Alive Wellness with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Site.
