This policy does not apply to any other websites or to the practices of companies that Lumvie does not own or control, or to people that Lumvie does not employ or manage. Lumvie Websites may contain links to third-party websites that are not owned or controlled by Lumvie. Lumvie has no control over, and assumes no responsibility for, the privacy policies or practices of any third-party websites. Information on such third-party websites may be obtained directly from those third-parties, possibly from their websites.

 

Registration Information: When You register with Lumvie and/or the Lumvie Website(s), and sign in to or use our services, directly or through third party applications or services, You are not anonymous to us. For certain services, we may request credit card or other payment account information which we maintain on secure servers. Lumvie collects information about Your transactions with us and with some of our business partners, including information about Your use of Products and Services that we offer. This information may include, but is not limited to any combination of phone number, email address, UDID, and/or device MAC address. Lumvie collects any attribute information that You provide that is relevant and/or required to offer Lumvie Products and Services.

 

Location Information: When You use Lumvie Products and Services Lumvie can collect location information and sensor data provided by Your device. This information may include, but is not limited to: GPS data (including, but not limited to device latitude/longitude, accuracy, heading, speed, and altitude), cell tower and Wi-Fi access point information.

 

Device Information: Lumvie automatically receives and records (collects) information from any device You use to view, register or download Lumvie Products and Services including, but not limited to, Your cell phone, tablet, PDA computer, personal computer, browser, car, appliances and M2M devices. Such records and information may include, but not be limited to, device-specific information, such as device UDID, device phone number, Your IP address, cookie information, software and hardware attributes, and the web page(s) You request.

 

Cookies and Website Data: Lumvie may set and access cookies on Your computer. A cookie is a small data string our server that writes to Your hard drive. This data string contains Your unique user ID for our Website. This technology also allows us to customize Your experiences when You visit the Lumvie Website(s). For example, we may be able to deliver content specific to Your interests, keep track of Your online ordering and alert You to new products.

 

Lumvie may let other companies that show advertisements on some of our pages set and access their cookies on Your computer. Other companies’ use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies may have access to Lumvie’s cookies.

Lumvie uses information for the following general purposes to: provide services that You activate or for other Products and Services, improve our services, contact You, conduct research, provide anonymous reporting for internal and external clients, and for sale to other clients or third parties in non-aggregated and aggregated forms (but only as set forth below).


The only way to prevent Lumvie from collecting personal information about You is to not use our Website, Products, Services and/or software, directly or through our business partners and other third parties who use our Products and Services as part of their offerings. Lumvie retains some historical personal information obtained through Your use of Lumvie Products and Services even after their removal from Your devices. Information Sharing and Disclosure

 

When Lumvie has Your permission (See “Your Consent” below) or under the following circumstances, Lumvie may rent, sell, or share personal information about You with other people or non-affiliated companies to provide products or services You have requested, or to present targeted advertising and content for You to see. We provide the information to trusted partners who work on behalf of or with Lumvie under confidentiality agreements. These companies may use Your personal information to help Lumvie communicate with You about offers from Lumvie and our marketing partners.

 

Lumvie reiterates that Lumvie, the Website(s) and all Lumvie Products and Services are not designed or intended to attract children under the age of 13 as users and Lumvie does not intentionally collect personal information from such children. However, if a parent/guardian permits their child under age 13 to register with Lumvie, to use the Website, and/or to use Lumvie Products and Services, then that parent/guardian is permitting Lumvie to collect and use their child’s personal information in the same manner set forth herein that Lumvie uses any other user’s personal information.

Lumvie may disclose or transfer the information upon the closing of a definitive agreement under which a majority of the outstanding stock or assets of Lumvie are acquired by a 3rd party.

 

Lumvie may display targeted advertisements and content based on Your personal information. Advertisers (including advertisement serving companies) may assume that people who interact with, view, or click targeted advertisements meet the targeting criteria, for example, women ages 18-24 from a particular geographic area. However, not all advertisements and content may be appropriate for You. If You disapprove of advertisements or content targeted to You, Your only choice to prevent further such advertisements or content being shown to You is to discontinue use of the Lumvie Website(s), Products and Services.

 

Access to information is limited to only those employees, contractors, agents and affiliates of Lumvie who have a reasonable need to access such information in the official performance of their duties. Lumvie may disclose location information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to a legal order or comply with legal process served on Lumvie; (b) protect and defend the rights or property of AnJeDa Fitness Inc.; or (c) act in urgent circumstances to protect the health and safety of any persons. Lumvie does not notify its users when their personal and/or location information has been disclosed to partners or 3rd parties.

 

Data Retention Policy/Managing Your Information

 

Lumvie indefinitely retains current and historical personal information and location data obtained through Your use of Lumvie Products and Services. Lumvie retains such information to improve its Products and Services and for Lumvie Products and Services to function properly. Lumvie may be required to retain certain information by law.

Lumvie is concerned about safeguarding the confidentiality of Your information. Lumvie provides physical, electronic, and procedural safeguards that comply with federal regulations to protect information we process and maintain. Lumvie limits access to personal information about You to employees who Lumvie believes reasonably need to come into contact with that information to provide products or services to You or in order to do their jobs. Discontinuing Use of AnJeDa Fitness Inc. Products and Services

 

At any time You may elect not to use Lumvie Products and Services and/or receive messages from us. You can stop all further collection of personal information by deleting and/or uninstalling Lumvie Products and Services from all devices containing Lumvie Products and Services, including, but not limited to, computers, hard drives, networks, mobile phones, tablets, appliances and M2M devices. Note: Lumvie may indefinitely retain historical location data obtained through Your use of Lumvie Products and Services. Lumvie may retain such information to improve its Products and Services and for Lumvie Products and Services to function properly. Lumvie may be required to retain certain information by law. Removing Lumvie Products and Services from Your devices may prevent You from receiving email messages regarding updates, improvements, or special offers.

 

Special Note Regarding Children

 

Lumvie believes that protecting the privacy of children on the Internet is very important. The Lumvie Website, Products and Services are not designed to attract children under the age of 13, and Lumvie does not intentionally collect personal information from such children. Ordering online products, services and information is limited to adults 18 or over. Children should exercise caution before providing personal information online and should discuss with an adult or guardian before doing so. General Data Protection Regulation (GDPR) Rights

 

Right of confirmation: You shall have the right granted by the European legislator to obtain from the controller the confirmation as to whether or not personal data concerning You is being processed. If You wish to avail yourself of this right of confirmation, You may, at any time, contact the controller.

 

Right of access: You shall have the right granted by the European legislator to obtain from the controller free information about Your personal data stored at any time and a copy of this information. Furthermore, the European directives and regulations grant You access to the following information:

  • the purposes of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;

If one of the aforementioned reasons applies, and You wish to request the erasure of personal data stored by Lumvie, You may, at any time, contact the controller. Lumvie shall promptly ensure that the erasure request is complied with immediately.

 

Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that You have requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. Lumvie will arrange the necessary measures in individual cases.

 

Right of restriction of processing: You shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested by You, for a period enabling the controller to verify the accuracy of the personal data.
  • The processing is unlawful and You oppose the erasure of the personal data and request the restriction of their use instead.
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by You for the establishment, exercise or defense of legal claims.
  • You have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of You.

If one of the aforementioned conditions is met, and You wish to request the restriction of the processing of personal data stored by Lumvie, You may at any time contact the controller. Lumvie will arrange the restriction of the processing.

 

Right to data portability: You shall have the right granted by the European legislator, to receive the personal data concerning You, which was provided to a controller, in a structured, commonly used and machine-readable format. You shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to point (a) of Article 6(1) of the GDPR or point (a) of Article 9(2) of the GDPR, or on a contract pursuant to point (b) of Article 6(1) of the GDPR, and the processing is carried out by automated means, as long as the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

 

Furthermore, in exercising Your right to data portability pursuant to Article 20(1) of the GDPR, You shall have the right to have personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others. Right to object: You shall have the right granted by the European legislator to object, on grounds relating to Your particular situation, at any time, to processing of personal data concerning You, which is based on point (e) or (f) of Article 6(1) of the GDPR. Lumvie shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override Your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.

 

If Lumvie processes personal data for direct marketing purposes, You shall have the right to object at any time to processing of personal data concerning You for such marketing. This applies to profiling to the extent that it is related to such direct marketing. If You object to Lumvie to the processing for direct marketing purposes, Lumvie will no longer process the personal data for these purposes.

Automated individual decision-making, including profiling: You shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning You, or similarly significantly affects You, as long as the decision (1) is not is necessary for entering into, or the performance of, a contract between You and the data controller, or (2) is not authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard Your rights and freedoms and legitimate interests, or (3) is not based on Your explicit consent.

 

If the decision (1) is necessary for entering into, or the performance of, a contract between You and the data controller, or (2) it is based on Your explicit consent, Lumvie shall implement suitable measures to safeguard Your rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and contest the decision.
