Terms and Conditions
DEFINITIONS
‘The Client’ refers to the party engaging Art of the Fairytale and to whom invoicing and correspondence will be addressed.
‘Art of the Fairytale’ is the trading name of Lorna Griffiths and Lorraine Taylor as the’Photographer/s’
‘Photographs & Photography’ encompasses all photographic material provided by the Photographer, Art of the Fairytale, including but not limited to, prints, digital files or any other physical or electronic means of representation.
These terms and conditions are applicable to all products, orders, quotes and services provided by Art of the Fairytale, and are applicable at every stage of the process.
SECTION 1 : PORTRAIT BOOKINGS
1.1 Portrait sittings take place at the ‘Art of the Fairytale’ studio or at an agreed location.
1.2 Your portrait fee will be confirmed at time of booking and is payable within 48 hours to secure the diary date and time. This is a non refundable deposit payment.
1.2a CHANGING BOOKINGS
Bookings that need to be changed should be advised as quickly as possible either by email, phone or social media messaging.
Booking dates can be changed without charge if 48 hours + notice is given.
Changes made within 48 hours of your sitting may incur an administration fee.
1.2b. NO SHOW
Failure to attend your photoshoot without notification will forfeit your sitting fee.
1.2c. CANCELLATION
Cancellations will forfeit the booking fee already made.
This is to cover the time already invested by the Photographer in preparing for and designing your studio sitting.

1.3 A confirmation message will be sent via text, email, or social media.
1.4 Clients are asked to make the Photographer aware of any physical or medical conditions that the sitter has prior to the photoshoot that may have an effect on the experience offered, so that adaptation may be discussed between the Photographer and Client.
1.5 Art of the Fairytale create portraits in several styles and genres which may be seen on social media and website galleries. Clients looking for a style that is not illustrated should contact the Photographer prior to the sitting to discuss.
1.6 By booking and payment of sitting fee / deposit, with Art of the Fairytale, the client is acknowledging and fully accepting the Terms & Conditions set out in this document.
SECTION 2: PAYMENTS & ORDERS
2.1 As detailed in Section 1, a non-refundable studio fee is payable on booking your studio sitting. Clients for ‘Beauty’, ‘Fantasy’ & ‘Beguiled’ sittings are required to pay their final sitting fee balance 7 days prior to their portrait date.
2.2. Payments may be made by Paypal, Card or Bank Transfer. We do not accept cheques.
2.3 Payment plans options are available for Art & Digital Orders.
Payment in full is required prior to your order being printed and processed.
2.4 Once an order is placed and paid for, it is understood that there will be no further editing or alteration to the photographs purchased. Additional edits may be commissioned and the Photographer will quote for this work prior to commencement. Payment for additional editing works must be made in full prior to the photographer undertaking the edit.
2.5 REFUNDS will not be given on digital products once purchased.
2.6 Art orders are collected in person and checked over with the Photographer. Any damage must be noted at this time prior to artwork leaving the studio. The Photographer is not responsible for damage to the product once it is handed over to the clients possession.
2.7 Art orders that are shipped by the Photographer that cannot be collected in person must be checked and any damage noted within 7 days of receipt. Photographs and details of the damage must be sent in writing to the Photographer. Goods will be collected and replaced and the Photographer will advise the Client on the timing of this as times vary depending on the item and time of year.
2.8 Art products are bespoke and uniquely created for each order and will not be refunded once an order has been placed and put into production. The unique and custom nature of photographic art is such that there is no cooling off period once an order has been placed.
2.9 By placing an order with the Photographer the client is committing to purchasing the products ordered.
2.10 Payment plan purchases are a binding contract either between the Photographer or with the Photographer’s Payment Partner Company. The client is committing to the purchase of the goods and completing the full payment. There are no refunds at any stage.
2.11 Failure to complete payment for your full order will render the client in breach of contract.
SECTION 3: YOUR PHOTOSHOOT
3.1 Please refer to section 2 regarding change of date or cancellation.
3.2 The client is responsible for ensuring the availability and attendance of all parties involved in the portrait.
3.3 The Photographer will provide all cameras, lighting and equipment necessary to create the clients portrait.
3.4 It is understood that all persons being photographed do so voluntarily and on the understanding that your images may be used on social media / website / advertising.
3.5 The photographer understands that children, babies and animals can often become upset or unco-operative during a sitting. In such circumstance, whilst it is not the fault of the Photographer, an alternative sitting will be offered. Due to the time and preparation already incurred by the Photographer, the new sitting will be subject to an additional session fee.
3.6 Working with children under 18.
The safety and protection of children is uppermost during your sitting.
Each child under the age of 18 must be accompanied by a parent or legal guardian during the photoshoot.

During the sitting it is often required to assist a child in a pose or adjust an outfit. This is undertaken by the Photographer & assistant, only with the parent / guardian’s consent.
Parents / legal guardians must inform the Photographer if they do not wish for their child’s images to be displayed on the photographer’s media, marketing material etc.
3.7 There is a strictly NO PHONE / NO CAMERA / NO RECORDING policy in place during your photoshoot and within our studio space.
Anyone found doing so will be asked to leave and the photoshoot terminated.
Due to the costs incurred by the Photographer, the session fee is forfeit.
3.8 Any damage to costumes, equipment or the studio by the Client, their pet or accompanying people will be charged for to repair or replace.
3.9 ATTENDEES
So that the focus is very much on the individual(s) being photographed, we ask that additional attendees are kept to a minimum.
There is a lobby waiting area outside our main studio for children and teenagers under 18 who are not being photographed. Clients are asked to bring an additional adult to the sitting to accompany children under 18 who are not being photographed.
3.10 QUANTITY of PORTRAITS
As an artist the photographer will make a judgement over the composition, poses, styling etc For ‘Beguiled’ and ‘Boudoir’ sittings this will include a pre-shoot design meeting with the client to discuss ideas. The final quantity of proofs is at the discretion of the Photographer. RAW files are not available to be viewed or purchased nor is the Photographer under any obligation to create additional edited portraits to those shown in the clients gallery reveal.
3.11 Clients images are hand edited by the Photographer and will include retouching at the discretion of the Photographer e.g. to remove blemishes.
Images are presented fully edited by the Photographer to the client. Adjustments requested by the client will be undertaken by the Photographer at additional cost appropriate to the level of work required and at the discretion of the Photographer.
The Photographer has the right to decline the adjustment of images that they feel may compromise or dilute their brand and quality of work.
3.11 CANCELLATION by PHOTOGRAPHER
Should the Photographer have to cancel a photoshoot due to reasons such as ( but not limited to ) illness, injury, weather, equipment failure then the client will be informed at the earliest opportunity in writing or phone call.
An alternative date will be given, or a refund of the sitting fee repaid, but the Photographer will accept no responsibility for any other losses incurred as a result of a photoshoot failure for the aforementioned reasons.
SECTION 4: COPYRIGHT & DATA PROTECTION
4.1 All copyright of all photographic images produced by the Photographer remain the copyright of ‘Art of the Fairytale’ at all times, nationally and internationally.
Purchase of digital files does NOT include purchase of copyright.
4.2 Digital files purchased by the Client are licensed for use for duplication for personal use only and not for commercial usage unless an agreed commercial licence with the Photographer is in place.
4.3 Digital files may be shared on social media and web platforms with accreditation to the Photographer at all times, either with a written link in text or with the use of the ‘Art of the Fairytale’ logo on the image. Each digital file sold is accompanied by a lower resolution version with logo.
4.4 The client agrees that digital images purchased must not be manipulated, added to, adjusted or re-coloured.
4.5 Breach of copyright terms may result in legal action being taken.
4.6 Art of the Fairytale do not outsource editing or store on clouds / offsite.
Your images remain on an internal back up drive at our offices for 3 months after your gallery reveal.
4.7 Art of the Fairytale retain your name, email address, phone number and address on an internal database. The client may opt out of marketing notifications by Art of the Fairytale at anytime by contacting the Photographer in writing.

4.8 Clients details are not stored externally or shared with any external third party and will only be used to fulfil purchase orders and for Art of the Fairytale communications.

Art of the Fairytale reserve the right to adjust and amend the
Terms of Conditions at any time without general notification.
